In my opinion, if you sell a cel with a background and do not explicitly state that
the "background is a copy" or "background is non-matching" then you are implying it
is indeed a "matching production background". Therefore if the seller knows it is not
a "matching production background" and does not state that fact, then he/she is
committing fraud. Now if the seller is simply including a background originally
received with the cel, and has no idea if it really belongs with it, then that's different.

If I were in your situation, I would do the following:
#1. Contact the seller and suggest her/she amend the item's description.
#2. If response is lacking or unfavorable, give negative feed-back.
    (I'm assuming this is on eBay)
