Now, aside legal matters, there is other factors.
What everybody publishing stuff on internet without
the agreement of the copyright holder do is hope that
they copyright holder won't feel annoyed enough to take
action.

That mean that if I do a website on Lodoss and put
5 or 6 scans from the ANAM artbook, the result probably
won't be the same as if I scan and publish the whole
artbook. Sure, there is nothing legal about that reasoning
but it's still valid:
Most companies will be tolerant to small breaking of
their copyright as long as they don't feel it becomes
a problem. (Ie: Pionner sponsoring a convention in
which fansub of their anime will be displayed. But
menacing to sue a distro group if they continue.).

Another factor is, as mentioned several times, ethique :
It's not because you can do something that you should
do it. Often in science, ethique is as strong as laws.
People breaking ethique rules won't be legaly punished
but there is other forms of punishment. Like being
shuned from the comunity.
Politeness and respect of others people work is part
of ethique's rules. And as I said, it doesn't cost
anything to ask someone before borrowing stuff from
his site so why not do it ? In the worse case, you
won't be able to use those pictures (big deal!) and
in the best case, you will make yourself a new friend.
(Oh! The only other fan of [a totaly stupid and unheard
of anime] currently alive on the planet !)
