I don't agree with that : Ok, there is nothing "official"
about it and it's not in the "law" but "fanart", like
"fansub" are supposed to be something made by fans as
an hobby. When it starts to be commercial (because it's
sold, auctioned or even traded for goods), there is
another name : it's bootleg.
When done in a way that people can't make the differance
with the original, it has yet a third name : Forgery.

Note that, at least with fansub, it's usualy not the
people who did all the work that try to resell them.
Actualy, the first person to be outraged when a fansub
is sold for more than the price of the tape, or worth,
auctioned, are the person who translated it, timed it
and made all the work.

It doesn't seems to much as much the case for "fancels"...
sadly...
